Companies in the travel sector carrying out activities related to the organization of trips and stays are legally obliged to provide a financial guarantee in accordance with Article L.211-18 of the Tourism Code.
What is it?
In accordance with Articles R211-26 to R211-34 of the Tourism Code, the financial guarantee allows, in the event of default of an operator, to reimburse all the advances paid by its customers and to ensure their emergency repatriation. In addition, in the event of cessation of payments resulting in the operator filing for bankruptcy, it ensures the repatriation of travellers and the assumption of additional living expenses.
This financial guarantee is mandatory to obtain registration with Atout France. It is renewable each year and ceases when the professional loses his licence or terminates his insurance contract.
